By accessing our website, purchasing a membership, booking a court, or participating in any of our activities, you agree to abide by these Terms.
1. Acceptance of Agreement
By accessing or using any portion of our services—including booking courts, registering for events, or visiting our website—you agree to be legally bound by these Terms. These Terms apply to all users, including members, guests, and participants in clinics, leagues, or tournaments. If you do not agree with any part of these Terms, you may not use our services.
2. Eligibility
You must be at least 18 years old or have the express consent of a parent or legal guardian to use our services. By using our services, you affirm that you meet this requirement.
3. Privacy Policy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you acknowledge that you have read and understood our Privacy Policy.
4. SMS and Communication Agreement
By creating an account or booking a court, you expressly consent to receive communications from The Pickle Club regarding your account, bookings, and facility updates.
- SMS Consent: You agree to receive recurring automated marketing and informational text messages (e.g., booking confirmations, waitlist alerts, promo codes) from The Pickle Club at the phone number provided. Consent is not a condition of purchase.
- Opt-Out: You can cancel SMS notifications at any time by texting "STOP" to the received message. For help, text "HELP".
- Rates: Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
5. Memberships, Bookings, and Fees
All memberships, court bookings, and programming are subject to fees as listed on our website or disclosed at the facility.
- No Refunds: All payments for memberships, court rentals, and events are non-refundable unless otherwise stated explicitly in writing by The Pickle Club.
- Price Changes: We reserve the right to adjust pricing at any time.
- Payment Processing: We use third-party platforms for booking and payments. We are not liable for errors or claims arising from the use of these third-party processors.
6. Cancellation Policy
Cancellation and rescheduling policies are strictly enforced to ensure availability for all members.
- Deadlines: Cancellations must be made within the timeframes listed on our booking platform.
- Penalties: Failure to cancel within the required window will result in the forfeiture of the full booking fee.
- Club Cancellations: We reserve the right to cancel bookings due to weather, facility maintenance, or force majeure events. In such cases, credit may be issued at our discretion.
7. Facility Rules and Code of Conduct
To ensure a safe and enjoyable environment, all players and guests must adhere to The Pickle Club rules:
- Attire: Proper athletic attire and non-marking court shoes are required at all times.
- Conduct: We enforce a zero-tolerance policy regarding harassment, unsportsmanlike conduct, or disrespect toward staff and property.
- Termination: Violations of these rules may result in immediate removal from the facility and termination of membership without refund.
8. Liability Waiver and Assumption of Risk
By entering the facility or participating in any activity, you voluntarily assume all risks related to physical activity, including but not limited to injury, illness, or death. You hereby release The Pickle Club, its owners, employees, and affiliates from any and all liability for any injury or loss associated with your use of our facilities. A separate, signed waiver may be required prior to play.
9. Intellectual Property
All content found on our website, marketing materials, and within the facility—including logos, designs, text, and media—is the exclusive property of The Pickle Club. You may not copy, reproduce, or redistribute any content without our written permission.
10. Termination of Services
We reserve the absolute right to suspend or terminate your access to our services at our sole discretion, particularly if you violate these Terms or behave in a manner detrimental to the club or its members.
11. Dispute Resolution and Governing Law
Any disputes arising out of or relating to your use of our services will be resolved through binding arbitration, waiving the right to pursue claims in court or through class actions. These Terms are governed by the laws of the State of New York.
12. Changes to Terms
The Pickle Club reserves the right to modify these Terms at any time without prior individual notice. Updates will be posted on our website and are effective immediately. Your continued use of our services constitutes acceptance of the revised Terms.
